§9-1 allows a post-employment non-compete only with all of these: a real business interest, a job that actually touches it, no more than two years, a reasonable place and trade, and reasonable compensation. Miss one, and the clause is hard to stand on. Handover and closing accounts are a different task. They do not wait for this article.

Print the clause, the period, the place, and the compensation. If the compensation line is empty, mark it.Write the materials this person actually touched. Do not stop at the job title.Accounts, keys, and files are handed over today. Whether the non-compete can be enforced is a later question.

Find

If the person is already at a competitor, preserve the records you are allowed to keep, then let a lawyer read the five conditions in §9-1. Do not open with a threat.
